Excerpt: The United States Environmental Protection Agency Region 8 (“EPA”), has the authority to issue and therefore is issuing this Administrative Order on Consent (“AOC”) pursuant to Section 7003(a) of the Solid Waste Disposal Act, as amended (the “Act”), 42 U.S.C. § 6973(a) (“Section 7003). Respondent Rhodia Inc. (“Rhodia”) neither admits nor denies that EPA has either jurisdiction or the authority to issue an order pursuant to Section 7003 for the matters described herein, but agrees to conduct the work in the manner and timeframes described herein.
